The Judicial Panel on Administrative Cases of the Astana Court upheld the decision from July 12 of this year, which recognized the decision of the Ministry of Justice’s Appeals Council and the registration of the “C.” trademark as illegal, reports Tengrinews.kz, citing the court’s press service.
As follows from the case details, on June 19, 2023, the trademark “C.” was registered to a citizen of Kazakhstan. Subsequently, Rolex SA filed an objection to annul this trademark, claiming that the trademarks “C.” and COSMOGRAPH (which belongs to Rolex SA) are similar to the point of confusion, which could mislead consumers about the product or its manufacturer.
On February 20 of this year, the Appeals Council of the Ministry of Justice refused to annul the “C.” trademark, after which Rolex SA filed a lawsuit.
The court declared the decision of the Appeals Council of the Ministry of Justice and the registration of the “C.” trademark illegal, as there is a high likelihood of confusion between products marked with the “C.” and COSMOGRAPH trademarks, which could mislead consumers about the product or its manufacturer.
“The Judicial Panel on Administrative Cases of the Astana Court recognized the decision of the first instance as lawful and justified,” the court’s press service informed.
