On November 6, 2025, the Senate approved the law on intellectual property issues.

The Law of the Republic of Kazakhstan “On Amendments and Additions to Some Legislative Acts of the Republic of Kazakhstan on Intellectual Property Issues” was approved by the Senate on November 6, 2025.

The law provides for legal norms aimed at:

– introduction of a new mechanism for the examination of trademark applications in an accelerated manner. Thus, preliminary examination in an accelerated procedure will be conducted within ten working days (usually within 1 month) and full examination in an accelerated procedure within three months (usually within 7 months) from the date of submission of the application;

– extension of the deadline for submitting an objection against the registration of the designation as a trademark for a period of up to 2 months (currently – for 1 month);

 – clarification of the reasons for refusal to register trademarks based on the place of service provision;

– establishment of the possibility of refusal to issue a patent for an invention at the stage of formal examination;

– introduction of specialization of patent attorneys in means of individualization and objects of industrial property.

Along with this, the Law provides for amendments aimed at ensuring the transparency of the system of collective management of rights, through its digitization and the introduction of a single digital platform in the field of collective management of rights, in order to ensure the rights of authors and copyright holders to receive fair remuneration for the use of their objects through the system of collective management.

In particular, one of the most important novelties of the Law is the provision of a single digital platform. Its implementation, management, information content, support and system and technical maintenance will be carried out by an expert organization – RGP “National Institute of Intellectual Property”, subordinate in its activity to the authorized body – the Ministry of Justice of the Republic of Kazakhstan.

The law will enter into force after signing by the President of the Republic of Kazakhstan and subsequent publication.
